Floyd County Supervisors Approve Settlement with Courthouse Project Architects

The trio of new Floyd County Supervisors have finished what the previous three Board members started in settling a financial dispute between the County and the design engineer for the law enforcement center and courthouse renovation project.

In July 2021, the County filed suit against Prochaska and Associates of Omaha for construction costs that exceeded the County’s budget and for breach of contract. Less than a month later, Prochaska countered with a claim that said Floyd County was in breach of contract for not paying for their services associated with the increased project costs.

Last month, the Board of supervisors, then comprised of Linda Tjaden, Doug Kamm and Roy Schwickerath, approved a tentative mutual agreement with Prochaska to settle the dispute.

During their regular meeting Tuesday morning, current Board Chair Mark Kuhn said it was time to sign the agreement and move forward.

Former Supervisor Linda Tjaden commended the Board, which also now includes Dennis Keifer and Jim Jorgenson, for finalizing the agreement. She added that the settlement was reached in large part through the increased efforts of County Auditor Gloria Carr and Sheriff’s Chief Deputy Pat Shirley.

Prochaska will pay the County about $67,000 while the County will pay Prochaska about $230,000, for a net County payment of about $162,000. Prochaska will also continue to supply construction administration services for about $8,700 a month until the courthouse project is completed.
